Judicial Reviews Results.
Judgement in the judicial reviews brought by HS2 Action Alliance against the Department for Transport was announced a few minutes ago at the High Court in London.
As you will be aware, HS2AA brought two separate judicial reviews-one concerning non-compliance with environmental law and the other dealing with the decisions made by Government concerning compensation arrangements for those affected by property blight.
The judge has this morning ruled that the Government acted unlawfully in its 2011 consultation process on compensation and have agreed for a fresh consultation to take place. This new consultation must be undertaken fairly and lawfully.
In respect of the second case concerning the environment, the judge agreed with the Government‘s position that the Strategic Environment Assessment Regulations did not apply to the HS2 project, but rejected the Department for Transport’s claims that it had complied with the requirements of the SEA Regulations in any event. This judgement leaves the field clear for HS2AA to appeal this case. As a result, HS2AA’s lawyers informed the Court this morning that it would be filing an appeal.
We have therefore won one case and lost one case in the first instance.
We will provide more information when we get it about fund raising, timing of appeals and next steps.
In respect of the compensation case, we believe this is a massive win for everyone opposed to HS2. The judge was scathing about the Department for Transport’s decision making on compensation, describing their actions as "odd” "muddled” and "bizarre”.
